This week in Spanish Property
The top 3 updates and market moves in Spanish property this week:
Spain's Congress threw out both housing decrees
On 2 October, Congress rejected both emergency housing decrees, the first by 178 votes to 172 and the second by 184 to 166. The 10% VAT on tourist rentals, the 2% rent cap and the automatic lease renewal are all now dead. If you let your property short or long term, nothing changes and the rules you followed before still apply.
Foreign buyers are paying 35% more per square metre than Spanish buyers
A new UCI study found international buyers pay on average 35% more per square metre than Spanish buyers. More of them are also relocating permanently rather than buying a second home. For owners, that means the people most likely to buy your property are the ones paying the premium.
Spain's two biggest unions have called a general strike over housing
UGT and CCOO have agreed a 24-hour general strike over housing affordability, with no date confirmed yet. The government has already brought a revised 21-measure housing package back to Parliament. Expect more rules aimed at rentals over the coming months, so keep your paperwork and contracts current.
Bueno Tax
If you own a home in Spain as a non-resident, you need to file an annual tax return called the Modelo 210. The 2025 return is due by 31 December.
As a registered partner of the Spanish tax office, we can file it for you. From €50, depending on the number of owners and properties. A flat with a garage that has its own cadastral number counts as two.
We work out what is owed and file on your behalf. We keep your details on file, so next year you do not have to think about it.
If you have unpaid tax for previous years (2021 to 2024) we can assist with the reporting and payment of the outstanding tax.
Reply to this email and we will start the process.

How to Maximise ROI When Renting to Seasonal Tourists in Spain
Two identical flats on the same street can return very different numbers. The difference is rarely the property. It is the licence, the pricing and the season you are set up for.

Why you must check tourist licence availability before you buy
How peak season differs between the coast and the cities
The amenities that justify a higher nightly rate
Dynamic pricing, long-stay discounts and early booking offers

Region Spotlight: Costa del Sol in Focus

Where your property stands this month:
Foreign buyers took 37.01% of all purchases in Málaga province in Q2 2026, a record 3,474 homes. Only Alicante is higher, at 46.43%.
More than one in three homes sold on the Costa del Sol now goes to someone who does not live in Spain. That demand is what has held prices up while sales volumes slow.

💬 Reader’s Question
Q: I rent my property short-term. Does the 10% VAT on tourist rentals apply to me now?
No. That measure fell with the decree on 2 October.
The decree was published on 1 October and lost legal effect the next day when Congress voted it down. It never applied in practice.
The same goes for the 2% rent cap and the automatic lease renewal. Nothing has changed in how you let your property, and the rules you were following before still stand.
Worth knowing: the government has already brought a revised 21-measure housing package back to Parliament. Nothing is law yet, but this is not over.
